SUBJECT OF THE CONTRACT

This Contract outlines the rights and obligations of both parties regarding the sale and delivery of Liven Decor products ("Products") ordered electronically through the Liven Decor website ("Website").

    • You acknowledge that interest rates and late fees are determined by your issuing bank.
    • By selecting an installment plan, you agree to the terms of your credit card agreement.
    • Payment due dates are set by your bank.

GENERAL CONDITIONS

4.1. Information Acknowledgement:

You confirm that you have reviewed and agreed to the product information, sales price, payment type, delivery details, and other preliminary information provided on the Liven Decor website.

4.2. Contract Confirmation:

By placing an electronic order, you acknowledge your understanding and acceptance of the complete product information, sales price, payment type, and delivery details.

4.3. Delivery:

Products will be delivered to the designated address within the timeframe specified on the website, not exceeding the legal maximum of 30 days.

4.4. Cargo Fee:

The cargo fee is the responsibility of the buyer. Liven Decor is not liable for delivery failures due to reasons beyond their control.

4.5. Delivery Obligations:

Liven Decor is responsible for delivering complete and undamaged products with any applicable warranty certificates and product manuals.

4.6. Product Substitution:

Liven Decor reserves the right to substitute a product of equal quality and price, with your prior consent, before the delivery deadline.

4.7. Order Impossibility:

If fulfilling the order becomes impossible, Liven Decor will inform you within the contract timeframe and refund the collected amount within 10 days.

4.8. Order Confirmation:

Electronic confirmation of the order information is required for delivery. Liven Decor is not obligated to fulfill orders with unpaid balances or canceled bank transactions.

4.9. Credit Card Misuse:

If your bank refuses payment due to unauthorized credit card use (not Liven D's fault), you are obligated to return the delivered product(s) within 3 days at your own expense.

4.10. Force Majeure:

Liven Decor is not liable for delivery delays caused by unforeseen circumstances like extreme weather or transportation disruptions. In such cases, you can choose to:

  • Cancel the order
  • Replace the product(s) with equivalent items
  • Postpone delivery until the situation resolves

If you choose to cancel, Liven Decor will refund your payment within 10 days (cash for cash payments, credit card refunds processed within 7 days with potential bank processing delays).

Credit Card Refund Process:

  • Banks may return installments based on your chosen number of installments.
  • Liven Decor will return the full amount to your bank in one transaction.
  • The bank may then refund installments to your credit card account, potentially resulting in a delay between Liven Decor's refund and the credit card statement reflecting the change.

Cash or Bank Transfer Refunds:

Refunds will be processed through a bank transfer to the designated account of the buyer (account holder name must match the invoice).

DEFAULT AND LEGAL CONSEQUENCES

Late payments on credit card transactions will result in interest charges and potential legal action from your bank. You agree to be responsible for any losses or damages incurred by Liven Decor due to delayed payments.

RIGHT OF WITHDRAWAL

Within 7 days of receiving the product(s), you have the right to withdraw from the contract without justification.

To utilize your right of withdrawal:

  1. Send a notification within 7 days of receiving the product(s) to Liven Decor. You can do this by:
    1. Registered mail with return receipt
    2. Fax (if applicable)
    3. Email (to the address provided in Section 1.2)
  2. Ensure the product is unused. The product must be returned in its original condition, including any packaging, manuals, and warranty certificates.

Return Procedure:

  1. Once Liven Decor receives your withdrawal notification, they will provide instructions for returning the product(s).
  2. You are responsible for returning the product(s) to Liven Decor at your own expense.
  3. It is recommended to use a trackable shipping method for your return.

Refunds:

  • Liven Decor will refund the full purchase price, including any applicable taxes, within 10 days of receiving the returned product(s) in good condition.
  • For credit card purchases, the refund will be processed through your bank. Please refer to Section 4.10 for details regarding potential bank processing delays.
  • For cash or bank transfer purchases, the refund will be made to the designated account used for the original purchase.

Exceptions to Right of Withdrawal:

You do not have the right to withdraw from the contract for certain products, such as:

  • Products that are custom-made or personalized to your specifications.
  • Products that are perishable or have a short shelf life.
  • Products that have been unsealed or used in a way that diminishes their value.

GOVERNING LAW AND DISPUTE RESOLUTION
